Reports reaching Kenya Today
indicates the ICC has removed
Nigerian Judge Chile Eboe-Osuji
whom a section of the prosecution
had felt uncomfortable with in the
case Prosecutor Vs Uhuru Kenyatta.
Osuji, under whose watch Uhuru’s
case has nearly collapsed, has
consistently sided with President
Uhuru in rulings which his critics
argued weakened the case against
Kenyatta, who is accused over the
post-election violence which rocked Kenya in 2007 elections.

February 2014, Judge Geoffrey A.
Henderson will replace Judge Chile Eboe-Osuji on the bench.
Geoffrey A. Henderson (Trinidad
and Tobago) was elected during the twelfth session of the Assembly of States Parties to the Rome Statute (ASP) in November 2013 for a term that will run until 10 March 2021. He was sworn in on 12 December 2013 at a ceremony held at the seat of the
Court in The Hague (Netherlands).
Trial Chamber V(b) will hence be
composed of Judge Kuniko Ozaki,
Judge Robert Fremr, and Judge
Geoffrey A. Henderson.
Background: Mr Kenyatta is
charged, as an indirect co-
perpetrator, with five counts of
crimes against humanity consisting
of murder, deportation or forcible
transfer, rape, persecution and
other inhumane acts allegedly
committed during the post-election violence in Kenya in 2007-2008. Charges were confirmed on 23 January 2012, and the case was committed to trial before Trial Chamber V(b). The trial commencement date of 5 February 2014 was vacated by the Chamber on 23 January 2014 and a status conference will be held on 5 February 2014 to address the issues raised by the parties and participants in relation to the Prosecution request for a 3-month
adjournment.

The International Criminal

has replaced Judge Chile Eboe-Osuji
on the bench at the Trial Chamber V
(b) in the case against President
Uhuru Kenyatta.
This might be a move to play with  the Uhuru's defense team psychological set up.
The ICC Presidency said the decision
followed Osuji’s request.
“On 30 January 2014, the Presidency

Director of US National
Intelligence, James Clapper, has
issued a warning to Kenyan
authorities that Al Shaabab
insurgents are planning a major
terrorist attack in Kenya.
While testifying before the Senate
Intelligence Committee on Capitol
Hill on Wednesday, the Director
said the Al Shabaab militants may
be planning new attacks on
Kenyan soil.
“East African Governments will
have difficulty protecting the wide
range of potential targets.”
Clapper said.
He also said the Somali - based
ragtag could also launch attacks on
Burundi, Djibouti, Ethiopia and
Uganda because of those countries'
troop contributions to the African
Union force in Somalia.
“The credibility and effectiveness
of the young Somali Government
will be further threatened by
persistent political infighting,
weak leadership from President
Hassan Sheikh Mohamud, ill-
equipped Government institutions
and pervasive technical, political
and administrative shortfalls,”
Clapper told the committee.

Thursday January 30, 2014 - The
tenth prosecution witness who is
testifying in the cases facing
Deputy President, William Ruto,
and his co-accused Joshua Sang on
Wednesday told the court that
Ruto uttered statements that
helped fan violence after the 2007
elections.
During his cross –examination by
tICC prosecution counsel, Regina
Weiss, the brave and composed
witness 128, told the court that
Ruto attended a rally at Kobujoi, in
Rift Valley where he allegedly told
members of the Kalenjin
community to massively vote for
ODM so that they can get a chance
to reclaim their ‘dispossessed’
land.
“I told you that Ruto asked the
Kalenjins to vote in massive
numbers and that once ODM takes
power, it was going to uproot
‘tree stumps’,” the witness told
the court.
When asked by the prosecution
what was the meaning of “tree
stumps”, the witness said the
word referred to non -Kalenjin
people who are living in the area.
He said Ruto was using his
vernacular language when talking
about the issue and the convener
of the said meeting was former
GSU commander, Samson
Cheramboss.
The former GSU commander is a
close ally of William Ruto.
The witness continues with his
testimony today………
